A punchy little case out of Tassie that shows that the gig is not necessarily up if your #company has received a creditor's statutory demand that has expired (raising a presumption of #insolvency) but you're confident that the company is actually able to pay all its #debts as and when due and payable. INSOLVENCY LAW | A recent judgment in the Supreme Court of Tasmania has highlighted the crucial role that compelling evidence plays in refuting a presumption of insolvency. The matter concerned a plaintiff's application to wind up the defendant company on the grounds of insolvency, based on the defendant's failure to comply with a creditor's statutory demand. The court ultimately dismissed the plaintiff's winding up application, holding that the defendant met its burden of proving it was solvent.
