DePaul University and Professor Jonathan Gross were sued on Aug. 16 in Illinois Circuit Court for Cook County in connection with sexual harassment. Revisiting Title IX’s Sexual Harassment Requirements While Avoiding Secondary Victimization: A Procedural Primer. Why Do Too Many Districts Not Know (or Abdicate) their Responsibilities? A number of my most-recent Expert Witness court cases have involved adolescent girls (in different states) who have been sexually harassed at their schools. As such, the cases involve the Sexual Harassment sections of the Title IX (2020) regulations. Through these cases, I have found that many school administrators and educators either do not know about this section of Title IX, or they do not know the very specific responses and actions required. This Blog provides a detailed “Primer” of the law’s definitions, procedural requirements and actions, and necessary policies. Also discussed here is the fact that districts must have a Title IX Coordinator, give the student alleging the harassment the option of a district-guided investigation, and that the district cannot abdicate this responsibility to law enforcement.
