Delay in disciplinary action results employee winning compensation for unfair dismissal! ⏳ Major General S. L. Mapyane, a high-ranking officer in the South African Police Service (SAPS), was dismissed for falsifying travel claims. Despite the seriousness of the charges, the Labour Court found that SAPS failed to act promptly, leading to a ruling in Mapyane's favor. Charges: Mapyane was accused of falsifying travel claims by claiming disbursements for trips made using SAPS vehicles as if he had used his private vehicle. Dismissal: Mapyane was dismissed after being found guilty on five charges. Arbitration: Mapyane challenged the fairness of his dismissal, particularly focusing on the excessive delay (over 3½ years) in initiating disciplinary action. Labour Court Ruling: The court found the dismissal procedurally unfair due to the significant delay but upheld the substantive fairness of the dismissal on two of the charges. Compensation: The court ordered SAPS to pay Mapyane compensation equivalent to three months' salary for the procedural unfairness. No Costs Awarded: No costs were awarded to either party. It is important for employers to take proactive steps to prevent abusive work environments and for lawmakers to enact policies that protect workers from harm.
