🎄 Seasons Greetings from CRL and the Fair Work Ombudsman... 🎄 Does your studio, agency, firm or business engage employees on 'fixed-term contracts' ("FTCs")? If so, as of 6 December 2023, there are new rules which apply to FTCs. Given the nature of video game development and other media projects, these changes may impact your ability to engage employees for the "life" of your project(s). These new rules include the introduction of three key limitations of FTCs and a new requirement to provide an employee a Fixed Term Contract Information Sheet (FTCIS). We discuss two of the three limitations below: Time Limitations: A FTC cannot be any longer than 2 years; and Renewal Limitations: A FTC cannot have an option to (a): extend/renew the term of the agreement so that the period of employment is beyond 2 years or (b): extend or renew the agreement more than once. Despite this, it is important to note that there are a range of exceptions to these limitations. A renowned preacher, his final words to his followers before his death on 1 March 589 were “Be joyful, keep the faith, and do the little things that you have heard and seen me do.” St David believed that we should “do the little things”, the small, considerate things that often make a big difference. What's one small thing you could do today that might make a big difference somewhere or to someone? - Check in with a friend or colleague you’ve not spoken to for a while? - Smile at someone as you pass them in the office or in the street? - Make someone a cuppa? - Let someone know you think they’re doing a great job? This week, the Fair Work Ombudsman (FWO) have advised of an update to the Fair Work Information Statement (FWIS). The FWO makes regular updates to this document, to ensure currency with legislative changes; the latest of which include: - Adding superannuation to the National Employment Standards (NES); and - The requirement to provide employees engaged on a Fixed Term Contract, with the Fixed Term Contract Information Statement (FTCIS) It is because of these regular updates that we recommend to our clients that they provide a link to the applicable Information Statements - Fair Work Information Statement, Casual Employment Information Statement and Fixed Term Contract Information Statement embedded in employment agreements, to ensure that the information provided is always the most up-to-date.
