Effective July 1, 2024, the Uniform Power of Attorney Act (hereinafter “UPOAA”) became the prevailing Michigan law on financial powers of attorney. This new Act is designed to simplify and unify financial powers of attorney not only in Michigan, but across the country. Can you remove a case to the Business Courts that was filed before September 1, 2024? It's something I've wondered and a few people have asked me about it. Now, based on this Law360 article, a few people have tried doing just that and the courts have asked for briefing regarding whether that is allowed. The one thing I haven't seen anyone mention on this issue, the actual bill (HB19) states at the end: "SECTION 8. The changes in law made by this Act apply to civil actions commenced on or after September 1, 2024." So, it appears to me that the new Business Court rules (including removing a case) does not apply to lawsuits filed before September 1, 2024. #TexasBusinessCourts
