Brands and logos are protected by registered trade marks whereas the clothes themselves need further consideration. Unregistered design right arises automatically in any 3D design if it is a unique shape, and can last for 10 years after the design was first sold or 15 years after it was created (whichever of the two is shorter). In addition, there is the option to seek a registered design. A registered design protects the overall visual appearance, shape and decoration of a product. You can protect 2D designs and surface patterns as well as 3D products. The design must be new and have individual character.
