CONGRATULATIONS TO CATE O'CONNELL, WHO OBTAINED DIRECTED VERDICT FOLLOWING TWO-WEEK TRIAL! Catherine O’Connell recently obtained a directed verdict for her client, a painting subcontractor, following a two week-long trial. The Plaintiff fell from a single-level baker scaffold while working as a painter on the jobsite and sued the general contractor, alleging that the general contractor failed to provide sufficient fall protection. In turn, the general contractor filed a third-party claim for contribution against the Plaintiff’s employer, a painting subcontractor. Prior to trial, Plaintiff demanded over $3 million. Following the close of both Plaintiff and Defendant cases, Catherine moved for a directed verdict, arguing that there was no evidence to support the contribution claim against her client, the painting subcontractor. The court agreed and prior to the case being submitted to the jury, entered a directed verdict in favor of the painting subcontractor.

FAQ! Can painting be included in the reserve study? For most condominium projects, painting is one of the largest expenditures that the Association will incur. Consequently it is logical that it should be included in reserves because it is not an annual maintenance expense. For most associations it will occur every 7 to 15 years. So why does this question even arise? In 1993 the IRS audited approximately 15 associations in San Diego, California that created a national furor within the industry. Like the strings of a marionette puppet, after the completion of a New York construction project, there are various legal theories that serve as ties between the builder and the owner. For the builder, the sooner these lingering ties can be removed the less exposure they face for claims of defects. For the owners, the longer they are able to establish these connections, the longer they may have legal recourse against the builder for defects. #construction #builder #defects

And here in India, we have companies harassing employees in the name of flexibile work hours and being inhumane. And when they lodge a grievance against who are harassing them - they are mistreated and punished because that someone is sort of a masterpiece in making for them even if that person is stealing someone else's work! A contract is simply an agreement between two or more parties that is legally enforceable. Once a contract is created, those parties agree to exchange something of value. For example, a painter agrees to paint your kitchen, and you agree to pay a certain amount for those services -- this constitutes a contract. Contracts are a common and indispensable feature of everyday life. Missouri law requires almost all contracts to be in writing, and you should always do so or otherwise risk your agreement being unenforceable. If you have questions about a contract you are involved in, don't hesitate to contact Piatchek Law Firm at 417-409-2420 to book a complimentary consultation. ☎️

Attention Illinois contractors and construction professionals! Are you aware of the option to substitute a bond in place of a mechanics’ lien. Section 60/38.1 is a game changer for those that have had liens recorded against their interests and for those that have recorded liens. When a party bonds over a lien there are profound - positive and negative effects to all concerned. To ensure that you are taking the necessary steps to bond over and object to bonding over, it's important to seek the advice of an experienced lien attorney. That's where I come in. As an attorney with a strong construction background, I offer no charge initial legal consultations to all. I believe everyone has the right to learn their rights in any legal matter without having to pay for it. Don't wait until it's too late. Book a no charge consultation with me at https:https:// https://lnkd.in/gEbaMcEK or reach out to me on LinkedIn or through my email at garysweiss@weiss-law-office.com to arrange for a consult. #construction #liens #contractors #mechanics

Let's not be penny rich and pound foolish....nobody likes a fool. Here's one of the MANY reasons why I recommend a pre drywall inspection (and an awesome tip at the end). This inspection is going to allow you to see gas, water, electric lines BEHIND the drywall (among a LOT of other things). This is super handy when it comes time to moving in and bolting shelves to walls, etc. TIP: Take pictures of each room and make notes ON THE PICTURE. Notice that I'm pointing to the line and made a note of what room it is!
