The Court of Criminal Appeal has held that the defence of Honest and Reasonable Mistake of Fact (HaRMoF) is NOT available for an offence of Drive with Illicit Drug in System (DwIDiS). After being convicted of DwIDiS in the Local Court, Mina Narouz appealed to the District Court. District Court Judge Buscombe dismissed the appeal (Narouz v R [2023] NSWDC 293, which I wrote about here: https://lnkd.in/dXEc-PbC ) Narouz argued that the offence of DwIDiS was an "strict liability" offence, meaning the Crown did not need to prove intention (or mens rea), but that the defence of HaRMoF was available. The Crown argued that the offence was a offence of "absolute liability" offence, meaning the defence was not available. After failing in the District Court, Narouz appealed to the Court of Criminal Appeal. The Court (Chen J with whom Bell CJ and Harrison CJ at CL agreed) dismissed the appeal. In finding the appeal should be dismissed, Chen J placed emphasis on a number of matters: - That the relevant section of the Road Transport Act does not expressly indicate whether the offence is strict liability or absolute liability [44] - That the "structure and language of [the section]... manifest legislative intent to displace the presumption that there is a mens rea element to the offence under s 111(1) and to create an offence of absolute liability." [60] - Contrary to Narouz's argument, that the fact that "a Second Reading Speech is silent on a particular issue does not mandate a conclusion that the legislature should, in and of itself, be taken implicitly to support the construction argued by the appellant." [71] - That Chen J was "unpersuaded that the possibility of ["hardship"] cases should be taken to override the public safety objectives to which reference has been made" [83] - That "the penalty attached to the offence is monetary (and moderately sized)" [85] Given the above, the court dismissed Narouz's appeal. R v Narouz [2024] NSWCCA 14
