Gene&Cell Therapy >> House passes sweeping healthcare price transparency reforms, reining in PBM practices: The House on Monday evening passed a wide-ranging bill that aims to make the healthcare industry more transparent, including amping up reporting requirements for insurers and banning spread pricing for pharmacy benefit managers. The 243-page bill, which was passed by a vote of 320-71 under suspension of the rules, was the culmination of work between the leaders of multiple committees and marks a major step forward in the bipartisan push to rein in PBMs. “This bipartisan legislation delivers on our commitment to lowering health care costs and providing increased transparency for patients — something 95 percent of Americans support,” House Energy and Commerce Committee chair Cathy McMorris Rodgers said. “It helps Americans save money on out-of-pocket expenses and seniors save millions on medicines through important Medicare payment reforms.” PBMs swiftly pushed back against the legislation, saying that it undermines their ability to establish the most cost-effective drug options for patients and will ultimately raise the price of medications. “Congress should acknowledge that the free market is working as evidenced by the concrete steps PBMs are taking to give employers more pharmacy benefit design choices and transparency — and not take Big Pharma’s bait and pass legislation that increases drug costs and Big Pharma profits,” the PBM lobby known as the Pharmaceutical Care Management Association said in a statement following the vote. Specifically, the bill requires PBMs to provide semi-annual reports to employer health plans with data on prescription drug spending. This includes the drugs’ acquisition costs, total out-of-pocket spending, its rationale for formulary placement, and aggregate rebate information. The bill also now ensures that any payment made by a PBM is passed through in its entirety to the pharmacy or provider that dispenses the drug and “is not retroactively denied or reduced,” the bill text says. The move, known as spread pricing, was included as part of a bill from Rep. Buddy Carter (R-GA). The package also includes legislation sponsored by Reps. Joe Courtney (D-CT) and Erin Houchin (R-IN) that requires PBMs and third party administrators to disclose compensation to plan fiduciaries. The legislation doubles down on an existing law that bans gag clauses, which prevent pharmacists from letting patients know about lower-cost drugs, confirming that the ban applies to all private health plans. Pharmacists could be great team members in value based care. With about 1/4th of patients having a pcp there is a clear opportunity to use pharmacists who are the most accessible hcps to improve care , access , experience and outcomes. However, this is a huge cultural shift and does come with some operational hurdles.
