Figuring out litigation time limits is simple, right? Any self-proclaimed trial lawyer who thinks that should consider another line of work Explaining such issues is often a challenge. While we are a Virginia law firm, we handle Federal Tort Claims Act (FTCA) cases all over the country. The FTCA statute of limitations is two years and is considered "procedural," and not controlled by the "substantive law" of the state in which the tort occurred. But not always. There are instances - usually involving issues of derivative versus independent wrongful death actions - where you may need to consider a state’s substantive law in order to figure out the date by which a suit must be filed Of course, different states have different limits. Different types of actions might also be different. This is certainly true in Virginia. The limits are different based on the circumstances. You must do a particular analysis of the facts at issue and that jurisdiction’s law. Then there is always the question of when does the clock start running, "accrual" in lawyer speak. Depending on where you are, this might be when you “knew or should have known” of the potential for a claim (which is the FTCA standard). In other instances, it’s when the first harm happened. In others, it might be a straightforward discovery rule. How such standards are defined is also variable. In malpractice cases, some jurisdictions don’t start the clock until the relationship with the healthcare provider has ended. This is sometimes called the “continuing treatment rule.” Sometimes, the clock stops. Lawyers also have our own special word for that, “tolling.” This can happen, for example, when someone is incapacitated. That’s not true everywhere, however. Some places are very narrow as to what might constitute tolling. Other places are less strict. Let’s not forget statutes of repose. Those harsh laws arbitrarily cut off an action after a certain period. It doesn’t matter whether you knew or even could have known of a possible case. After a certain passage of time and, voila, no case. Many lawyers could read the above and (rightfully) accuse me of being simplistic or even off-base. Non-lawyers might think it sounds like gobbledygook. Well, today was not just a moment of sloppy drafting. (Plenty of those instances.) I wanted to make the point that calculating time limits is, as doctors would say (and I am accused of liking to say), multifactorial. It's a lot more than just looking at a simple rule and then plugging something into the calendar. All trial lawyers know that, you might say. That's true, but SOLs and SORs can be situations where familiarity breeds sloppiness. Not long ago, we were talking about a prospective case. I instantly and decisively declared it was time-barred. A paralegal quickly (and nicely) pointed out the error in my analysis. Oh yeah, that was kind of embarrassing. But I am glad someone knew to call me on it. #triallawyer #lawyerlife
