Oyinkansola Fawehinmi, an entertainment lawyer and convener of the Global Creative Legal Summit (GCLS), has said there is urgent need for the establishment of dedicated Intellectual Property (IP) Court in Nigeria. The entertainment lawyer and convener of the Global Creative Legal Summit (GCLS), said that with Nigeria’s creative economy rapidly expanding, the absence of an IP court is seen as a critical legal infrastructure deficiency. Speaking during the inaugural summit which took place at the Landmark Events Centre between September 17 and 20, Fawehinmi said establishing an IP court in Nigeria is not only essential but long overdue. Experts who spoke at the event also backed Fawehinmi’s position, believing that a dedicated IP court would among other things, ensure efficient handling of intellectual property disputes, and provide protection for creative works that fuel industries such as music, film, fashion, and technology. Nigeria’s lack of proper legal structures leaves creators vulnerable to infringement, with inadequate recourse. Source: Premium Times

Bondoc și Asociații SCA annuls a decision rendered by ANPC sanctioning unfair commercial practices in the advertising and audiovisual media sector Bondoc și Asociații SCA scores a new success in a dispute over unfair commercial practices, specifically in the advertising and audiovisual media sector, thus contributing with a significant case law precedent. The case involved addressing both a specific regulation on unfair commercial practices and the imperative of applying principles such as reasonableness and proportionality in the application and interpretation of the law, as well as the practical significance of the obligation to ensure that consumers are fully and fairly informed. The dispute also raised the issue of predictability in the interpretation and consistent practice that an authority is required to follow, the complexity of the case also pertaining to the previous recurrent inspections of the economic operator in question made by the ANPC. Thus, by its recent decision, the court has validated the interpretation and analysis proposed by Bondoc și Asociații on these legal issues, annulling the contravention sanctioning decision. This new successful outcome once again confirms the broad expertise of Bondoc și Asociații team in dealing with highly technical subjects and legal issues that require an analysis and interpretation of legal provisions in convergent areas. Day 12; Arbitration for Entertainment. It's Day 12 guys and I'm happy to be here again. Today, 28th of October, I’m exploring the intersection of Contracts, Arbitration, and Entertainment Law in Nigeria—a key but often complex area for creatives and industry professionals. As Nigeria’s entertainment sector grows, so also, the issues and challenges in managing contracts. These agreements, covering artist deals, licensing, distribution, and management, are critical. And, with global attention on Nigerian content, contracts must be clear to avoid costly disputes. Essential clauses in entertainment contracts include: 1. Royalties: Define revenue splits from streaming, merchandise, and other sources. 2. IP Rights: Clarify ownership, ensuring creators retain control while permitting fair use. 3. Termination Clauses: Set clear conditions for ending the contract, minimizing the risk of disputes. Why Arbitration for Entertainment? Arbitration is often preferred in the entertainment industry for its confidentiality and speed. Because unlike court cases, arbitration keeps matters private, protecting reputations and sensitive IP. Flexibility is key too; panels with industry expertise can better understand nuances like streaming revenue or distribution terms. With Nigeria’s new Arbitration and Mediation Act 2023, awards now face fewer delays in enforcement, making arbitration even more appealing for content creators and producers. International Arbitration for Nigerian Content. With Nigerian content reaching global audiences, international arbitration centers like the LCIA or ICC play a critical role. Cross-border arbitration ensures Nigerian creatives can resolve disputes internationally, enhancing global trust in our contracts. For creatives and stakeholders, understanding contracts, IP rights, and arbitration options is really essential for fair and efficient resolution of disputes, particularly as the industry expands.
