Your special needs child should not directly inherit monetary gifts. Typically, your special needs child should receive their inheritance through a Special Needs Trust so your gift does not put them over the asset limitation threshold of any government assistance program. It's Wednesday Q&A! ⏰ Q: Should I leave money for my child with special needs in my will? -Parent A: It's best not to leave money directly in your will. Doing so could jeopardize your child's access to critical government benefits. Instead, consider a Special Needs Trust. This ensures your child receives financial support without affecting their eligibility for government programs. 💡 . . . #cheeverlaw #sandiegoattorney #sandiegoestateplanningattorney #legalservices #businessplanning #estateplanning #trusts #wills #trustattorney #trustsandestates #lawyer #elderlaw #estateplan #specialneedstrusts #willsandtrusts #attorney #livingwill #revocabletrust #powerofattorney #guardianship #specialneedsplanning #modernestateplanning #estatelawyer #lawyersofinstagram

If you have a blended family, you may want to consider special protection in your estate plan for your biological children. If you don’t clearly outline your wishes, your child may not receive any inheritance. For example, if your assets all pass to your new spouse, when she eventually passes years down the line, everything may be divided among her children – and your biological children may be excluded. Make sure you consider various scenarios. If you don't have a Will, and everything passes directly to your minor child upon your death, the court will need to appoint a Conservator to control/manage the funds until your child turns 19. There is a very good chance the child's biological parent (your ex-spouse) will be appointed as the Conservator. If this is against your wishes you need to establish a Will to make sure a Trust is established for your minor child, at your death. That way YOU can name the Trustee to be in charge of the assets for your child. What is a Trust and who are they for? 💭 A trust is a legal arrangement that allows assets such as property or money to be looked after for the benefit of the beneficiaries named in the Will. Trusts are often used to hold assets for children until they are old enough to receive them. This section provides an introduction to the basic principles of Trusts, which will help you to prepare for a more detailed discussion with your adviser. https://lnkd.in/e2ek3FF2 #Trusts #EstatePlanning #Worthing
