On September 21, 2023, six lawsuits in Alabama accused State officials of systemic discrimination against children with disabilities. Today, the scope of these lawsuits has been broadened to hold accountable several key State agencies. A 2020 report from the Alabama Disabilities Advocacy Program (ADAP) showed troubling pictures and findings from their monitoring of disabled children entrusted to the State and placed in residential treatment facilities in deplorable conditions: concrete slabs for beds, feces on floors, and blood on windows. Birmingham attorneys Tommy James of Tommy James Law, Jeremy Knowles of Morris Haynes, and Pensacola attorney Caleb Cunningham of Levin Papantonio Rafferty represent the plaintiffs.
