The Supreme Court just overturned the long-standing principle of Chevron deference, in a 6-3 decision, holding that courts may not defer to an administrative agency's interpretation of the law simply because the statute is ambiguous and the agency interpretation is permissible, because the federal Administrative Procedures Act requires “the reviewing court,” to “decide all relevant questions of law” and “interpret . . . statutory provisions.” I have a robust administrative law practice relating to decisions of municipal and state agencies. Our state standard, in applying the Uniform Administrative Procedure Act, does not automatically provide deference to an agency's interpretation of an ambiguous statute. CT's Supreme Court has instructed that while a time-tested agency interpretation of a statute will be afforded deference, such deference is appropriate only when the agency has consistently followed its construction over a long period of time, the statutory language is ambiguous, and the agency's construction is reasonable. But, if a statute is not ambiguous, or if the agency's construction of the statute is not consistent, time-tested, and reasonable, the court's review of the agency's construction of the statute is de novo. I'm curious how others think SCOTUS's decision will impact our administrative appeals in CT? SCOTUS was guided by the language of the APA. But CT's UAPA, is less clear when it comes to interpretation of statute: "The court shall affirm the decision of the agency unless the court finds that substantial rights of the person appealing have been prejudiced because the administrative findings, inferences, conclusions, or decisions are: (1) In violation of constitutional or statutory provisions; (2) in excess of the statutory authority of the agency; (3) made upon unlawful procedure; (4) affected by other error of law; (5) clearly erroneous in view of the reliable, probative, and substantial evidence on the whole record; or (6) arbitrary or capricious or characterized by abuse of discretion or clearly unwarranted exercise of discretion."
