Constitutional adjudication is a political exercise. Like legislators horsetrading to build majorities for or against legislation, the justices use deception, delay, persuasion and compromise to build winning majority coalitions that create and destroy constitutional law. The Court’s destruction of the right to choose created by Roe v. Wade is an example of the internal politics of decision-making within the Court. The recent New York Times article chronicling the demise of Roe is a lesson in Constitutional history that has few rivals. Read it to further understand how the high Court governs our lives and enables a growing police state, as recent events in Texas illustrate.

The Anti-Abortion Absolutists Are Moving to Reanimate the Frankenstein's Monster That Is the Comstock Act. A law that was passed in in 1873 that has never been repealed, just not enforced in modern times, that "bans the mailing of “obscene, lewd, lascivious, indecent, filthy or vile” material, including devices and substances used “for producing abortion, or for any indecent or immoral purpose.”" This Project 2025 initiative is why I have long advocated for legislatures to form committees whose sole purpose would be to identify laws on the books that need to be repealed, and then draft omnibus legislation that would repeal such laws in bulk. #voteblue #protectwomensrights https://lnkd.in/gp9J5tGk
