👔 White Collar Forensic LLC Tuesday Tips - Killing the Messenger 💡 📅 Every Tuesday, we share a single piece of advice. Today's tip is about the importance of separating the message from the messenger when conducting whistleblower investigations. 📢 Confidential reporting and internal investigations are an essential element of effective compliance programs. Individuals who use confidential reporting channels such as hotlines are often referred to as "whistleblowers". It is a word that is fraught with stigma and yet whistleblowers put everything at risk by coming forward. 👣 Consider for a moment what it must be like to make an anonymous report that something illegal is going on within their employer. Is it something that people do lightly? Hardly. In fact, it is a life changing decision in the worst way possible. Whistleblowers risk their jobs, financial future, friendships, careers and even their lives. All to do what they think is right and just. 🎁 What do they get in return? Acts of retaliation, fired, hate mail, death threats, smear campaigns and isolation. 🕵🏽♀️ Adding to the burden of being a whistleblower is the fact that sometimes investigators may not find them credible or believable and allow that to color their actions. How often is a whistleblower labeled as disenfranchised or a malcontent? 🖊 Not everyone knows what is important to convey in a whistleblower complaint or letter. And not everyone good at converting their thoughts into the written word. Consider our loved ones who are socially awkward or even a little eccentric. How might they be perceived in a whistleblower context? None of these things mean that what they are saying isn't true or credible. It is important to separate personal biases or disbelief of the whistleblower from what they are trying to communicate. 📬 Some of the biggest, most consequential investigations in history were brought forward by whistleblowers and yet they continue to be marginalized and vilified. As investigators, we have a solemn duty to get to the truth. Part of that duty is to treat each whistleblower complaint as worthy of our unbiased and full attention despite any preconceptions we may have. 📸 Focus on what the complainant is saying as opposed to how they are saying it. Vet the allegations and see if they can be independently verified. If yes, then you now have a sufficient basis to carry the investigation forward. 🗣 Confidential reporting and the investigations that follow are a critically important component of your compliance ecosystem. Separate the message from the messenger. Vet out the facts. Determine whether the allegations have merit irrespective of how the whistleblower comes across. 👔 White Collar Forensic LLC Tuesday Tip - Threatening Messages 🔦 🗓 Each Tuesday, we share a tip we hope you will find helpful in managing your day to day organizational risks. 😡 Sadly, there's a lot of anger out there. Anger leads to threats. Emails. Text messages. Voicemails. Handwritten letters. Spoken threats. 🙉 Your first instinct may be to ignore it but organizations have a duty to provide their employees with a safe workplace. ⚠ A threat investigation may reveal underlying tension within the company indicating there's something wrong with the organizational culture. 💥 ~2 million people per year in the U.S. fall victim to workplace violence. 400,000 aggravated assaults occur at the workplace each year and 350 victims are shot and killed. A threatening message may be the only warning your organization receives before tragedy strikes. 🕵🏽♀️ Interview the victim. Are they in a conflict with someone? Is that person capable of violence? Do they need a safe place to stay? If the person making the threats is known, actions can be taken. Employees can be suspended and denied access to the workplace. If its domestic abuse, the police should be notified. Your organization's security personnel can provide increased security for the person being threatened and advice on how to avoid future interactions. In some circumstances, it may be necessary to temporarily provide an executive protection detail. ⁉ If the person making the threats is unknown, it is more difficult and yet still should not be taken lightly. There are resources available to evaluate anonymous threats. 🔮 Former criminal profilers can assist security professionals in evaluating the language being used to make the threats to gauge if the person making the threat intends to carry them out. 🛡 If there are suspects, they can be interviewed by investigators and warned of the consequences of continuing to make threats. ⚖ Certain attorneys specialize in assisting the victims of stalking and domestic violence. They are adept at using legal processes to back the bad actor off and spurring law enforcement agencies to take action. 🛠 Forensic tools that can be utilized to identify the sender of spoofed emails or text messages, analyze voicemails or other recordings and piece together security camera video footage to track movements and determine if someone has been near the victim despite having been warned to stay away. ☂ Your actions may be the difference between a simple threat and actual violence. 👔 White Collar Forensic LLC Tuesday Tip - Ask the Stupid Question 🔦 🧓🏽 People expect professional investigators, forensic accountants and compliance advisors to be experienced, knowledgeable and know a lot about a lot of things. ⛵ And yet, our professional lives often involve venturing into the unknown. 🚒 We spend much of our professional time "drinking from the firehose" in order to ingest information at an accelerated rate. We must gain an understanding of an organization, its industry and the fraud, corruption or money laundering scheme that is taking place therein. 💥 Along the way, you will very likely encounter words, phrases, acronyms or the names of individuals or companies with which you are completely unfamiliar. ⁉ What do you do? 🧙🏽♂️ The polite thing to do may seem like you shouldn't interrupt, nod knowingly as if you have some degree of comprehension and hope that at some point the meaning of the mystery term or expression will magically reveal itself. That almost never happens. 👩🏽🎓 Human beings don't want to seem uninformed or uneducated. Get over it and ask the stupid question. Your job is to get as much information as possible from the interaction and you may not have a second opportunity to interact with this person. 🎂 The results may surprise you. The interviewee may be impressed with how carefully you were listening and feel good about themselves sharing this knowledge with you. It may also remind the interviewee that some what is being discussed is unfamiliar territory and they may preemptively explain the meaning of terms, phrases or industry jargon going forward.
