In a webinar we ran last year with Lockton and PureCyber Limited about demystifying cyber, an ACCA member asked how he could be sure that his PII cover included sufficient cyber attack cover/remediation. The responses were eye-opening: “When analysing your PII policy, always perceive the cover provided is insufficient, as the policy is unlikely to have the incident response team that is required during a cyber-attack. Not only do you want to ensure that you are covered for financial loss, but you also want to ensure that you are well equipped to deal with the incident itself – both during and post incident. My approach is that if cyber remains a business critical concern, then always assume that the PII cover will not be sufficient and obtain a Cyber policy. It’s vital firms prioritise building a resilient infrastructure to protect themselves from cyber criminals to manage the risk, at which point consulting a broker to talk through the risk transfer solutions will enact on assessing the suitability of individual wordings, especially given the three levels of exclusions on PII for cover and losses that insurers have brought in following intervention by the PRA.” Jack Bassett ‘Your PII policy is really there to protect your clients so there is very limited cover for a practice in relation to a cyber loss. Under the ACCA Lockton scheme, the PII policy provides limited third-party liability cover for losses emanating from a cyber event. Professional indemnity is a negligence policy, so you have to have made some sort of error for cover to be triggered.
