What employers must ensure, now that all dismissal complaints must be referred to the Industrial Court - The Edge Malaysia Sharing our views featured in The Edge Malaysia, the preeminent business, investment and economic weekly newspaper in Malaysia and Singapore. Recently, the Court of Appeal ruled that it is mandatory to refer an employee’s dismissal complaint to the Industrial Court if the director-general of industrial relations (DGIR) cannot resolve the matter. Prior to the amendments to the Industrial Relations Act 1967 (IRA 1967), the DGIR had a duty to refer wrongful dismissal complaints to the minister of human resources. The minister then had the discretion to choose between two courses of action: either referring the dispute to the Industrial Court or dismissing the claim in its entirety. There is now a certainty that every dismissal complaint shall or must be referred to the Industrial Court if it is not resolved at the conciliation stage at the Industrial Relations Department. Employers must be aware that complaints filed by their ex-employees will all be referred to the Industrial Court if they are not settled at the conciliation stage. As such, it is important to make sure due processes are strictly followed by employers before any termination of employment, be it misconduct, poor performance or even a redundancy situation.
