The Consumer Disputes Redressal Commission, SW Delhi found Max Bupa Health Insurance Corporation Limited liable for deficiency in service after wrongfully rejecting a genuine claim based on unfounded pre-existing conditions. In this case, the complainant had transferred her policy to Max Bupa, assured that her coverage continuity was intact despite renewing her policy and making timely payments. Her claim of rupees 24565 for hospitalization expenses was denied, forcing her to self finance. The Commission observed that there was no documented. History of the alleged pre-existing condition and directed Max Bupa to pay the claim amount along with Rupees 20,000 for mental agony and rupees 5000 for litigation costs.
