📈 NBCC India Gains 12% on ₹15,000 Crore Order Win! 🌍 NBCC, a Navratna PSU, gained 12% today after securing a significant ₹15,000 crore order from the Srinagar Development Authority. The project involves developing a satellite township over 406 acres in Rakh-e-Gund Akshah, Bemina, Srinagar, Jammu & Kashmir. 📊 For perspective, this order is almost equal to half of NBCC’s market cap , which stands at ₹33,000 crore. 🏗️ Recent order wins 🔹₹100 crore work order from REC in June 🔹₹878 crore from Kochi Metro Rail, Delhi University, Oil India, and the Institute of Company Secretaries 🔹Other order wins, including a ₹50 crore work order on August 1, and orders worth ₹443.61 crore and ₹411.45 crore on July 30 and July 29 📈 Stock Performance This stock gained 36% in the past month and 283% in the past year.

Whether, after approval of Resolution Plan and issuance of LoI, an Unsuccessful Resolution Applicant can question the conduct of the Committee of Creditors(CoC) and challenge Resolution Plan of Successful Resolution Applicant(SRA) – Dhansagar Dealers Pvt. Ltd. Vs. Mr. Anubrata Gangoly, RP of Carnation Industries Ltd. – NCLT Kolkata BenchIn this important judgment, while approving resolution plan in the matter of Carnation Industries Ltd., Bench of Kolkata NCLT comprising of Ms. Bidisha Banerjee and Shri Arvind Devanathan, has held that: (i) Any modifications or revisions of any plan after the approval of the plan by the CoC, even if undertaken as per directions of the CoC, shall not be entertained unless the CoC grants the subsequent approval. (ii) An unsuccessful resolution applicant has no vested right to challenge the approval of a resolution plan. (iii) The approval of Resolution Plan falls within the arena of “commercial wisdom” which cannot be questioned unless there is a violation of law as enshrined under Sections 30(2) and 31 of the I&B Code. (iv) Once a resolution applicant fails to succeed in the bid, it neither has a locus to question the action of the stakeholders qua members sitting in and controlling the CoC, nor the right to enhance or revise the monetary value of its Resolution Plan to compete with the plan of the Successful Resolution Applicant. #ibc2016 #cirp

The NCLAT Delhi recently overturned an NCLT Ahmedabad order in Shiv Glitz Hotels and Resorts LLP v. Oravel Stays Ltd. The NCLT had dismissed a Section 9 application under the Insolvency and Bankruptcy Code (IBC), 2016, without providing the operational creditor, Shiv Glitz Hotels and Resorts, an opportunity to rectify application defects. Shiv Glitz had issued a demand notice for unpaid invoices related to services provided to Oravel Stays (OYO). The NCLAT ruled that the NCLT was required by law to allow a seven-day period for defect rectification, making the NCLT’s order unsustainable. MCA Update: 1. The Central Government hereby *establishes a Central Processing Centre* at Indian Institute of Corporate Affairs, Plot No. 6,7,8, Sector 5, IMT Manesar, District Gurgaon (Haryana), Pin Code- 122050 having territorial jurisdiction all over India. 2. *The Central Processing Centre shall process and dispose off e-forms filed along with the fee as provided in the Companies (Registration of Offices and Fees) Rules, 2014.* Previously, it was done by Jurisdictional RoC. 3. *The jurisdictional Registrar,* other than Registrar of the Central Processing Centre, within whose jurisdiction the registered office of the company is situated *shall continue to have jurisdiction over the companies whose e-forms are processed by the Registrar of the Central Processing Centre in respect of all other provisions of the Companies Act, 2013 and the rules made thereunder.* 4.
