On February 21, 2024, the White House issued an executive order aimed at enhancing the security of US ports. This order encompasses several initiatives, such as empowering the US Coast Guard to oversee maritime cybersecurity, mandating the reporting of cyber incidents, and allocating resources to fortify critical infrastructure within US ports. These measures underscore the administration's commitment to bolstering cybersecurity across vital sectors, acknowledging the growing reliance on interconnected systems within the maritime industry. Furthermore, they highlight the convergence of economic and national security interests within the Marine Transportation System (MTS). Importantly, this executive order is not an isolated effort but aligns with a broader administrative strategy addressing perceived national security risks and potential disruptions to supply chains, particularly those supporting critical infrastructure. These regulatory actions include: (a) the USCG's issuance of MARSEC Directive 105-4, aimed at combating cyber threats and vulnerabilities associated with Chinese sourced ship-to-shore cranes; (b) the President's issuance of Executive Order 14116, expanding the authorities of the USCG to combat maritime cyber threats and the creation of additional cyber incident reporting requirements for the maritime industry; and (c) the USCG's issuance of proposed regulations, updating its existing MTSA regulations with an enhanced focus on cybersecurity requirements applicable to vessels and facilities under US jurisdiction. Today the Biden Adminstration announced major steps to secure America’s port infrastructure. The EO includes actions to address address maritime cyber threats, and directs the Coast Guard to issue a Security Directive with respect to the cybersecurity of cranes at ports and develop a new rule establishing minimum cybersecurity requirements that meet international and industry-recognized standards to best manage cyber threats. This action follows as part of over $20B in investments to America’s critical infrastructure by President Biden. We have a rare opportunity to not only reinvest our infrastructure, but also ensure its security and resilience - particularly in the the face of known threats from nefarious state actors including the PRC.
