EPA has published a final rule at 40 CFR 118 that becomes effective on May 28, 2024. This rule requires facilities that meet applicability requirements to develop, submit to EPA and implement a Facility Response Plan (FRP) in accordance with the due dates outlined in the rule. Applicability criteria include on-site quantities of Clean Water Act (CWA) hazardous substance(s), distance to a navigable water or a conveyance to navigable water, and meeting one or more condition(s) of substantial harm criteria. The regulation includes specific elements that must be included in FRPs, review and certification requirements, and requirements for training and drills/exercises.
