#insolvencynerd Every couple of years I like to scroll back through Chapter 5 (External Administration) of the Corporations Act and reflect on provisions that may impact on the types of #insolvency work we are currently undertaking in our team. This insight flows from that and a realisation that, with more #receiverships emerging in the current #financial climate, there is likely to be more focus on the validity of such appointments. Best to be prepared to deal with that.
INSOLVENCY INSIGHTS | As businesses face heightened financial pressures in the current economic climate, a rise in restructuring and insolvency activity will likely lead to more receivership appointments - and in turn, scrutiny or doubt as to the validity of these appointments. Under section 418A of the Corporations Act 2001 (Cth), a receiver, corporation or creditor may apply for a court order declaring whether a receivership appointment is valid or invalid. Notably, it is 'a reminder to secured creditors to thoroughly consider, prior to an appointment (of a receiver), the enforceability and validity of their security documentation such that a robust enforcement strategy can be pursued'.
