The REACH microplastics restriction will be enforced in Northern Ireland. The European Commission is amending Annex XVII of REACH within the EU. This amendment pertains to the marketing or use of synthetic polymer microparticles. The EU REACH restriction affects any synthetic, solid, non-biodegradable polymer used in cosmetics. This legislation does not apply to the GB market, which has adhered to UK REACH since January 1, 2021. However, to maintain access to the EU single market, Northern Ireland follows certain EU regulations concerning chemicals, including REACH. Consequently, the restriction will be applicable in Northern Ireland. Products containing synthetic polymer microparticles marketed in Northern Ireland must comply with the limits set by the updated Regulation. The Department for Environment, Food and Rural Affairs (Defra) has released an explanatory memorandum detailing the new requirements and their application in the UK and Northern Ireland. On March 13, 2024, the European Commission (EC) released draft text for the 18th amendment to the Plastics Regulation, (EU) No 10/2011 on the Public Consultations website of the European Commission. The draft amendment proposes additional requirements that represent a serious challenge to the continued compliance and marketing of plastic food-contact materials in Europe. On March 13, the European Commission (EC) has released an initiative to seek feedback on the proposal to update quality control rules for plastic food contact materials. This draft regulation aims to increase quality control under Regulation (EU) No 10/2011 on plastic FCMs by: • ensuring alignment with Regulation (EU) 2022/1616 on recycled plastics and Regulation (EU) No 528/2012 on biocidal products; • introducing purity requirements for substances obtained from waste and natural materials; and • adapting migration testing of multi-layer materials and repeat testing. It also adds quality control rules to Regulation (EC) No 2023/2006 on good manufacturing practice. I have been closely following the #EU Packaging and Packaging Waste Regulation (#PPWR) The PPWR is the proposed EU legislation that applies to all packaging. Today, 24 April 2024, is the day the regulation is expected to be officially finalized. 🗝 Key points are: ↪ Applies to all packaging (not just plastics) ↪ Aims to minimize packaging waste ↪ Establishes design for recyclability ↪ Requires recycled content ↪ Focus on monomaterial packaging ↪ Establishes mandatory PCR targets for plastics ↪ Once entered into force, it will apply throughout the European Union for all packaged goods, including imports. ↪ Exception: Pharmaceutical and medical packaging is not included in this legislation until 2035 when it will be revisited. I see a lot of similarities with the discussions in Australia through Australian Institute of Packaging (AIP) and Australian Packaging Covenant Organisation (APCO) and I believe we can expect a very similar approach in other regions.
