“The #Mortgage Bankers Association and the #Community Home Lenders of America have #opposing opinions about the #Federal Housing Finance Agency’s #pilot to #waive lender’s #title insurance requirements for #certain refinances. In a #recent letter to #FHFA, the #MBA argued at #length that the #pilot inappropriately #infringes on “#primary mortgage market #activities.” In #part, that’s because #title insurance is #part of the #origination process. Meanwhile, #CHLA, which #represents small/midsize lenders, #supports the #pilot, noting that it will #save homeowners “a #significant amount of #money in #closing costs on their #refinance.” The #pilot is still being #developed. #Fannie Mae noted #late last week that it #plans to #issue a #request for #proposals to #identify technology #suppliers to #participate in the #pilot by the #end of #June.”

Hill will present a Pennsylvania Bar Institute CLE, “Distressed Commercial Real Estate: A Primer on Forbearance, Restructuring and Recovery,” as part of the PBI Real Estate Hot Topics Seminar on June 20, 2024. The presentation will analyze the framework and use of commercial real estate loan modifications, forbearance agreements, deeds in lieu, short sales and other options for loan workouts. It will compare the negotiation strategies of the mortgagor, mortgagee, guarantor, and rescue capital provider. It will provide examples of various provisions that the parties in interest would propose to obtain advantages as well as those to achieve compromise.
