SHOULD THE CLAIM BE SETTLED OR DECLINED The general code of conduct requires that financial services providers (FSPS) take care of the interests of their clients and employ resources, procedures, and technological systems to prevent their clients from suffering risks and financial loss. FSPs must have mechanisms to advise clients of possibilities of losses and how to mitigate the losses. I was approached by a client, FSP with a matter. MRS C (not real name) has a policy with FSP, which covers MRS C’s son, amongst other dependants. The son was 17 years old at inception of the policy but passed on at 21. FSP declined to honour the subsequent claim on the grounds that the deceased was no longer a child, in terms of the policy. FSP further alleged that, the onus was on MRS C to advise FSP that son was no longer a child, so that a new policy had to be arranged. On the other hand, MRS C averred that she was not aware of this and needed guidance. How would you advise here? A registered FSP must have system generated reminders to your clients to warn them of any upcoming changed circumstances which might lead to financial loss or further financial commitment. These new circumstances include: 1. Changes in age (age group), e.g. from child to adult dependants. Most policies charge very low premiums, or no premium at all, for children, and higher premiums for adult dependants. 2. When premiums are outstanding, and the policy is approaching lapse status. 3. The fact that nobody has been nominated as beneficiary, and that such would delay release of the benefit in the event of death of policyholder. You can also include more examples. The crux of the issue is, the FSP must guide the client to avoid financial losses/ or heavy financial commitments, emanating from gullibility, or even oversight on the part of the client. Back to MRS C’s case. The question is; Whether or not the FSP should honour the claim. Supporting FSP’s position, is the fact that the definition of ‘child’ was clearly given in the terms and conditions to the policy, which had been explained to MRS C on inception of the policy. RIGHT. That seems like MRS C has been beaten hands down. But wait, if the matter is brought for adjudication by Ombudsman, the issue of compliance with code of conduct comes up and weighs heavily on the determination. IT'S THE WEEKEND! 😍 Well for me.. I am off on a mini break CHILDFREE! 🎉 This is cause for celebration.. however, before I go, I wanted to post about a really exciting role we have on at the moment! ⭐ WFH with two days in the City ⭐ £85k-£95k 'You’re number 2 running a commercial underwriting department, when really you are number 1 🙄 Sorry, it’s a touchy subject isn’t it. But I had to say it so bluntly to get your attention. The fact you’re basically propping up the P&C Underwriting department says it all. Constantly coming up with ideas to contribute to the P&L. And all that networking with brokers. Building solid relationships throughout the UK has helped to grow the book of business. You’ve got a proven track record. So why haven’t you taken that next step yet? I mean, it’s not as if you haven’t been asking for it. Or working your a** off to get it. But I have some good news. You can have that next step. But not where you are now. It’s with an MGA with serious appetite for growth. Where you’ll work in the city two days a week. And have full P&L responsibility with plenty of autonomy. Free rein to build relationships with brokers throughout the country. Making sure they’re using this MGA for their Property & Casualty business. And that’s really what you can get your teeth sunk into. Because there are other ‘Heads of’ within the retail side of the business that deal with other areas. So you can just focus on what you do best.
