Last month, Emerge Law Group's east coast team sat down with podcaster Rob Sanchez CSP-PO, PMI-ACP on his show, Apartment 113, to discuss the evolving legal cannabis industry. Natalie Diaz, Brittany Tovar, and Delia Rojas talked about the recurring issues, similarities, and disparities within legal jurisdictions, including potential solutions to these challenges. They also examined the unique status of cannabis legalization as an anomaly to the Supremacy Clause, and considered the positive and negative implications in the event of federal legalization or declassification.

Following the keynote delivered by Maryland State Senator Jill P Carter, fireside chat with Will Tilburg hosted by Jonathan Havens, discussions on business, regulatory, and criminal justice perspectives, I had the exceptional opportunity to share my knowledge and insights on how to achieve social equity in the Maryland and U.S. cannabis industries as part of the panel discussion “Social Justice Perspectives” moderated by Khadyne Augustine, JD, LBSW and joined by Chanel White, J.D. and Dayvon Love.
🎯 When we talk about social equality and social equity, there is a clear distinction between the two. Our collective focus on achieving social equity means that we are working on eliminating disparities, recognizing that there are differences amongst all of us. Different tools and initiatives are required for individuals and communities. Whereas, social equality oftentimes neglects systematic oppression, e.g., access to capital for Black and Brown aspiring entrepreneurs and the positive economic impact of a cannabis business on an entire community, not just the license owners.
➡️ Not only do we need to create specific inititiatives such as the the most recent round of licensing in Maryland specific to social equity applicants where the Maryland Office of Social Equity (OSE) did an exceptional job of supporting aspiring entrepreneurs. The OSE, led by Audrey Johnson, delivered throughout the 2023-2024 application process under a crazy short timeline. We know that to achieve full success, programs and initiatives cannot end there.
💵Maryland’s successful social equity licensees are required to hold their license for five years before a sale. The five year mark is a critical point in the lifecycle for success in any industry - most businesses fail by the five year mark. Success at the five year anniveratry is even more exceptional for cannabis industry social equity entrepreneurs who face more obstacles for success.

Cal NORML To Cover New Cannabis Laws in California at 2024 Legal Seminar
Event to Be Held January 20 in Oakland; CLEs Pending for Attorneys
Cal NORML is hosting a Legal Seminar aimed at educating attorneys and the general public about current cannabis laws in California, pending federal actions, and more on Saturday, January 20 from 10-5 PM in Oakland, CA and online. The event will cover both individual rights of marijuana users in California and cannabis business law.
First on the agenda will be the new employment rights laws that took effect in California on January 1, thanks largely to the efforts of California NORML, which sponsored AB 2188 (2022), banning employment discrimination by most California employers due to drug tests for inactive metabollites of THC, such as urine or hair tests. A second law, SB 700 (2023) outlaws asking about a potential employee’s past cannabis use. Presenting on this topic with be attorney Daniel Latter of Los Angeles, and Cal NORML director Dale Gieringer.
Another new law that took effect on January 1, SB 1186 (2022), will also be discussed. It requires cities and counties to allow deliveries of medical cannabis within their borders, and has a mechanism by which patients can sue jurisdictions if they cannot access their medicine in a “timely and readily accessible manner.” Cal NORML board member Lauren Mendelsohn will be presenting on this topic, and also on the topic of Cannabis Lounges and Events, covering liability and other issues.
Also covered will be new enforcement laws against unlicensed cannabis businesses, several of which Cal NORML worked on in 2023 to ensure that personal or medical gardens or small businesses were not unduly impacted. Presenting on this topic will be attorney Ron Naulls of Los Angeles, and Cal NORML board member Bill Panzer will give a presentation on excessive fines for cannabis operations and the 8th amendment.
On the business side, attorney Timothy Alger will cover key cases affecting cannabis businesses. Cal NORML board member Hirsh Jain will present on the state of local retail licensing for cannabis businesses across California, and Cal NORML legal committee member Dana Cisneros will present on the timely topic of Corporate Transparency. The event will wrap up with a presentation by Khurshid Khoja on the potential ramifications of federal rescheduling of cannabis.
Cal NORML has been hosting Legal Seminars since 2017, all of which have qualified for Continuing Legal Education credits from the California Bar. Pending this year are 5.5 hours of CLE credit for attorneys.
Founded in 1972, Cal NORML is a nonprofit membership organization that advocates for the rights of cannabis consumers in California. It is the state chapter of the National Organization for the Reform of Marijuana Laws.
