The Jury has selected the winners of the two categories: PhD thesis and article in personal data protection. Konrad Kollnig’s PhD thesis conducted a technological and legal study into mobile apps on how to improve data protection in practice. The key innovations of this work lie in bridging the gap between law and technology, as well as developing new technical methods to study data protection in apps. Building on this work, Konrad Kollnig is now writing a book on how to regulate the app economy. The article “Investigating Deceptive Design in GDPR’s Legitimate Interest” approached how legitimate interests are being used in practice, and how users perceived these practices through two empirical studies: a web crawl of 10,000 top sites and a survey to investigate how end-users perceived legitimate interest’s practices. The author, Lin Kyi, explained why legitimate interests are often difficult to object to, and therefore leading to lower engagement rates, as well why user preferences should be considered when creating and revising data protection laws and defining industry standards. 🎖 Our CHI’23 paper on “Investigating Deceptive Design in GDPR’s Legitimate Interest” is a winner of the #StefanoRodotà Data Protection Award 2024! 🔗https://lnkd.in/dqhXAM3H 📢 Abstract: Legitimate interest is one of the six grounds for processing data under the European Union’s General Data Protection Regulation (GDPR). The flexibility and ambiguity of the term "legitimate interests" can be problematic; coupled with the lack of enforcement from legal authorities and different interpretations from the various data protection authorities, legitimate interests can be taken advantage of as a loophole to collect more user data. Drawing insights from multiple disciplines, we ran two studies to empirically investigate the deceptive designs being used when legitimate interests are applied in privacy notices, and how user perceptions line up with these practices. We identified six deceptive designs, and found that the ways legitimate interest is applied in practice does not match user expectations.

One of the things I've struggled with a lot over the years is website design & messaging. How do you tell your story (sell your product, service, etc.) on your website? With the recent launch of the Couplr AI partnership with The American College of Financial Services we also relaunched the Couplr AI website. I know we hit the mark with the new design when an industry veteran I met with today told me we "nailed" our value proposition and clearly explained what problem we were solving, for who, and how we did it. Given I've been an advisor and fintech founder for some time and that we support loads of advisors, I wanted to share some tips that hopefully will help you get the most out of your website. ✅ Less is more. Keep your website design clean and simple. Lots of white space it OK. Don't have a ton of pages and make each page like a mini journey the user goes on. ✅ Take users on a clear journey by telling a story (Problem, Pain Points, Solution, Features, etc.) so they naturally progress from Problem to Your Solution and it all makes sense. ✅ Have a clear audience. Who is your ideal client/customer? Everything you say and illustrate on your website should be speaking to them. ✅ Use minimal CTAs. Does confuse people by giving them 10 things they could do. Give them 1-2 clear action items and tell them why they should Click, Subscribe, Request a Demo, etc. ❇ Bonus Tip - Your website will never be perfect! You'll constantly be tweaking it over time so don't get hung up on making it perfect, it never will be. I once worked on an app to help citizens document potholes. The brief wanted to make it easier to do so using new tech. I'll never forget a council employee saying; 📢 "No matter how good you make this, we've not got the money or time to fill all those potholes in" 📢 It's all I think of when I see orgs jumping on AI/ML to make things 'quicker to do'. The reality is a problem with supply and demand. The supply of the core outcome/output that people want is not possible. It's merely an upfront way to badly set increased expectations of users - We can make it faster to process job seeker allowance but can we really get more people into work? - We can make it 'easier' to get in touch with a company we bought something from, but can you actually get your return as per your consumer rights? - We can scan a road and auto-report potholes and other street furniture issues from our mobiles but will the council actually fix them? We can totally reduce the time humans spend doing tasks that computers are better at doing (and we should) but it's a fundamental re-think of service delivery and what we value. The removal of humans from frontline delivery because automation also poses issues (a post for another time) The conversation we really need to have is; If we free up the time of people doing things computers can do in our services, can we really switch these jobs/roles into ones that matter? Roles at the frontline in care, health, education, supporting people? Can we really commit to baking in the time it takes to build supportive relationships in our communities, in our support services, in our public services? Or will the cynic in me be right? That the profit driven business models of our capitalist institutions see the reduction of labour by AI/Tech as a way to save money and increase shareholding, rather than invest back into a system of care + new roles and support in our society?
