I'm not sure what the piece of equipment is, if it is in direct contact with food or just the packaging. Either way, the damage increases the risk of foreign object contamination; micro would also be a concern here as those crevices would be ideal for bugs to live. I would also add that I would venture into the maintenance of this piece of equipment as the damage looks to be old and has been present for a while. As for the BRC clause, I will go with 4.6.1, which covers equipment used on a site and the condition of the equipment.
