On January 14, 2025, the U.S. Federal Highway Administration (FHWA) published a Final Rule terminating a longstanding manufactured products waiver as part of the agency’s continued implementation of the 2021 Infrastructure Act’s Build America, Buy America (BABA) provisions. The waiver, originally established in 1983, limited application of the FHWA’s Buy America requirements to only iron and steel products, while permitting recipients of FHWA financial assistance to turn to foreign sources for more complex products. However, in accordance with the BABA’s express direction for agencies to review and reconsider waivers of general applicability such as the manufactured products waiver, the FHWA has rescinded that waiver as part of growing trend. FERC Passes New Transmissions Rules: On November 21, FERC issued a new version of its sweeping transmission rule to allow for stronger state participation in power line mapping. The revised order passed on a bipartisan vote, replacing a more controversial version of the rule adopted in a split vote by the commission in May. The rule requires transmission providers to consider a wide range of economic and reliability benefits when deciding what transmission projects to build.

Less than a week before President Biden left office, the U.S. Department of Transportation’s Federal Highway Administration (FHWA) published a final rule updating its Buy America rules to rescind FHWA’s long-standing waiver of Buy America restrictions for “manufactured products” used in federal-aid highway projects. The rule now faces uncertainty under President Trump, who took office on January 20, 2025, and issued a “regulatory freeze” for rules published by the Biden Administration that have not yet taken effect. While the Trump Administration has indicated it might strengthen Buy America requirements, it remains to be seen whether it will modify or delay the final FHWA rule.
