DOJ Marijuana Rescheduling Notice of Proposed Rulemaking A quick status as of 6/26/2024. With 26 days remaining in the original 60-day comment period, regulations.gov has received more than 25,000 comments to the proposal to reschedule marijuana from schedule I to schedule III. Several comments requesting an extension to the 60-day period have been received so it’s quite likely we’ll see an additional 30-days or more added to the comment period. In addition, several groups have requested a hearing on the matter which will likely extend any outcome. June 20th was the deadline to request a hearing. The decision whether to hold a hearing is made by the DEA administrator. Should DEA grant a hearing, a notice will be posted in the Federal Register establishing the date and time. As of 7/23/2024, one day after the comment closing date for this notice of proposed rulemaking, there are approximately 43,000 public comments posted on regulations.gov. As I've stated before, rulemaking is not an opinion poll or popularity contest so the sheer volume of positive or negative comments doesn't hold much weight. No doubt that DEA has been busy sorting and categorizing comments for response throughout this process. Unknown is whether a requested hearing on the issue will be held.
