The Supreme Court of the United States’ recent ruling in Loper Bright Enterprises v. Raimondo dealt a significant blow to the power of federal agencies by ending the 40-year-old precedent commonly known as “Chevron deference.” Loper has now removed the judicial mandate that courts apply “Chevron deference” and defer to agencies on the interpretation of ambiguous language in laws pertaining to their authority. While it is unclear what impact this ruling will have in environmental enforcement cases as well as environmental regulations, federal judges will now have the power to decide what a law means for themselves, expanding the federal bench’s role in enforcement actions and policymaking. #LoperBrightRuling #ChevronDeferenceOverturned #environmentrules

In the past 48 hours, in its Loper Bright, Ohio, and Jarkesky opinions, the Supreme Court majority has dramatically decreased the power of the Executive Branch of our Federal Government and dramatically increased the power of the Judicial Branch. One has to have been alive in the first half of the 20th century to have experienced anything like the new order the SCOTUS has established (or reestablished if you're a Federalist). Pretty much everything will change, including in Federal Environmental law, and it will be critically important that the Legislative Branch do its job which is pretty scary in light of recent behavior by that Branch of our Government. The recent SCOTUS decision overturning Chevron deference demonstrates that administrative law is in flux. We will look at the implications of the decision on administrative law in a variety of contexts as the Courts are already witnessing an increase in litigation challenging agency decision-making.
