Yesterday, I attended a webinar delivered by two members of the Regulatory and Public Law team at Wilkin Chapman Solicitors. Emma Hastings-Bray and Nick Alstrom explained in-depth the importance of ensuring that websites (and the information collected from them) are compliant with UK GDPR. The message was clear: users must be given a choice and be able to refuse non-essential cookies with the same ease as they can accept them. Under the GDPR, consent is often an inappropriate lawful basis. If you can’t offer people a genuine choice over how you use their data, you can't rely on consent. Here are some examples of when consent is not an appropriate lawful basis: - If you’d still process the data on a different lawful basis if an individual refused or withdrew consent - You ask for ‘consent’ to the processing as a precondition of people using or accessing your services e.g. making people sign up to marketing emails before they can access your services, and denying access to those who don’t sign up - You are in a position of power over the individual – for example, if you’re an employer processing employee data Can't rely on consent? Consider Contract, or Legitimate Interests. They've probably got you covered. There's more to the GDPR than just consent. #GDPR #LawfulBasis #Consent
