One of our clients recently went through this in Malaysia. They face a wave of imitation products in Malaysia. The new forms will be effective on 𝟭𝟲 𝗠𝗮𝘆 𝟮𝟬𝟮𝟱! 𝗞𝗲𝘆 𝗰𝗵𝗮𝗻𝗴𝗲𝘀: 𝟭. 𝗟𝗼𝗰𝗮𝗹 𝗔𝗴𝗲𝗻𝘁’𝘀 𝗗𝗲𝗰𝗹𝗮𝗿𝗮𝘁𝗶𝗼𝗻: Forms will include a new declaration confirming an agent’s local physical presence. For IP owners, this means ensuring you instruct a legitimate agent with a physical presence in Hong Kong. 𝟮. 𝗘𝗻𝗵𝗮𝗻𝗰𝗲𝗱 𝗗𝘂𝗲 𝗗𝗶𝗹𝗶𝗴𝗲𝗻𝗰𝗲: Additional fields have been added to gather information on IP owners, grantees, (sub)licensees, etc. In particular, companies can now specify their place of incorporation when renewing their marks and recording a licence. This change is aimed at enhancing due diligence and facilitating smoother IP transactions.
