An interesting case on "easement" with the defendant fighting to protect a pūriri tree from being removed... The plaintiff successfully applied for an order to create new entry points to a right of way (ROW) under the Property Law Act 2007, s 313, including removing a tree and part of a fence, plus some works to form new carriageways. The High Court noted that the absence of those trees in the legal easement did not necessarily mean there was an absolute right to require removal. After a thorough analysis of "reasonable use" in the circumstances, the High Court held that it was not reasonable for the defendant's aesthetic concerns arising with a single tree gap to override the practical requirements and convenience of the plaintiff as owner of the benefiting land. The plaintiff was also awarded general damages of $15,000, assessed as an appropriate sum to cover an extended period (since October 2021) during which the plaintiff could not use the relevant access point. 📸 Exciting day at The Perecman Firm, P.L.L.C. We had an amazing photo shoot today, and I couldn't be more thrilled with how it went. It's fantastic to see so many of my colleagues participating in our firm's marketing efforts. The energy and enthusiasm everyone brought to the shoot are truly inspiring, and I can't wait to see the final results! On another note, I had a deposition yesterday on a case involving a man who was seriously injured in an elevator accident at a major commercial building in Manhattan. Our team did a phenomenal job uncovering critical records from the Department of Buildings (DOB) about this accident. These investigatory findings were not turned over in discovery by any of the defendants. This brings me to an important point about the laws in New York that protect defendants from having to disclose post-accident remedial measures. In my opinion, this has led to significant evidence that could be crucial to a case potentially not being included in the discovery process. What are your thoughts on this issue?
