ISLAMABAD: The federal government is contemplating a significant increase in regulatory duties on imported used vehicles in the upcoming federal budget, scheduled for presentation on June 12. Sources indicate that the regulatory duty on vehicles with engines larger than 1800cc is expected to rise by 30 percent. For even larger vehicles, the duty could escalate from the current 70 percent to 100 percent. Additionally, a 15 percent duty may be imposed on used vehicles up to 1800cc, while both new and used hybrid vehicles up to 1800cc may continue to benefit from zero duty. These potential changes could make imported used vehicles more expensive in the country. The Overseas Investors Chamber of Commerce and Industry (OICCI) has also weighed in, recommending that the federal government maintain regulatory and additional customs duties on imported used cars. The OICCI's proposal aims to discourage the import of used cars to protect the local automobile industry, which they argue is suffering from reduced sales due to the influx of used vehicles. Diversion of the destination of export goods contrary to the Bill of Lading is a violation of FEMA (erstwhile FERA) & RBI guidelines. In a recent FEMA case of Green Ways Shipping Agency Private Limited, a leading sole agent for a shipping line in India, was imposed penalty for diverting export consignment of black tea to Dubai instead of its original destination Moscow. On review of the facts, Tribunal held that right from issuing of lading, it was clear that the appellant was well aware & actively involved in the diversion of consignment in connivance with the exporter & hence the penalty was justified. Learning note: In export cases, full compliance of FEMA (Exports of good Goods & Services) 2015 regulations need to be ensured to ensure that destination stated in the declaration is the final destination of goods exported.
