The committee is examining this area because of what it says are long-standing concerns over court capacity, resources and delays Drawing on its members’ considerable experience of pursuing claims for seriously injured individuals in the courts all across England and Wales, FOCIS drew attention to very significant delays including over eight weeks to issue a new claim. The period from receipt of an application to an interlocutory order being typed now adds at least a four-month delay. This compounds the time taken from issue to trial which has risen from 59 weeks in 2019 to 80 weeks in 2023. These delays considerably impact upon #accesstojustice for injured victims, often leaving them without an adequate remedy which can cause severe hardship. FOCIS has considerable sympathy for the court staff who are under resourced in a system, and in buildings, that need significant investment and very much hope that this committee is able help to persuade government to take the steps that are needed to reduce delays and expedite #civiljustice.

When P’s civil claim is compromised, a deputy will have to consider telling P about the value of their claim. It can be a difficult decision particularly where P is vulnerable to financial exploitation and the settlement is significant. Three authorities have previously attempted to grapple with the issue of whether P ‘should be told’ about the value of their claim: EXB v FDZ [2018] EWHC 3456 (QB) PBM v TGT [2019] EWCOP 6 DXB v PXL [2019] EWHC 2579 The very clever Tom Young and Sam Firth (and I!) didn’t consider that formulation of the capacity decision was quite right so Hayden J was asked to provide guidance in two linked cases. It is great to see the justice secretary @ScotGovJustice acknowledge our work on the not proven verdict in her written response: ow.ly/Moph50RgVCi The proposals outlined in the Bill #VWJRBill are based on evidence indicating that transitioning to two verdicts of guilty/not guilty will lead to an increase in convictions in finely balanced cases. This finding has been most prominently set out in the independent Scottish jury research, the most extensive and realistic study of its kind ever conducted in the UK, as well as in recent publications by Jackson et al. (2024) and Curley et al. (2022) - "These two studies are considered to be the most robust within the existing literature, on account of their stimulus material being more realistic than alternative studies, as set out in a recently published analysis by Jackson et al.
