When Chester Racecourse opened, Henry VIII was king. And they'll proudly tell you that, because part of their tone of voice is to scatter in fun racing history facts. I was training the Chester team to use the tone of voice last week, and we had a good talk about how organisations with a generally light-hearted tone of voice should handle bad news – like having to cancel a race day. We tend to instinctively get serious in these moments, dropping the frivolity and becoming highly formal. And while it's right not to make light of bad situations, upping the formality makes our writing feel stiff and distant, at exactly the time when people are hoping for some humanity. There's no magic form of words that'll stop people feeling disappointed they don't get their day out. But we can acknowledge and share that disappointment rather than (very English-ly) holding at arm's length. And if you share the reason for the disappointment, sometimes people will agree with it! If a race day is called off, for example, it's usually for the safety and health of the horses. And the racecourse and the guests can all agree they want the horses at their best. This is a big weekend. Tomorrow is the Kentucky Derby and May 4th so lots of Star Wars fans will be celebrating. On Sunday, we celebrate Cinco de Mayo and Orthodox Easter! Whew! That's a lot of celebrating! 😁 Saturday marks the 150th run for the roses at the Kentucky Derby. To check whose favored to win, check here: https://buff.ly/44mP4Ct. Interestingly, a logo design to celebrate the 150th was filed last year by Churchill Downs, but the application was just published for opposition this week. The application was held up for three months because of the failure to anticipate the disclaimer of KENTUCKY DERBY in the application, which no doubt has acquired distinctiveness . That time could have been saved if the applicant would have filed the application with a partial 2-F claim from the get-go. Looks like the earliest the Notice of Allowance will issue on this celebratory logo will be around July. Here's the lesson - when planning to file a trademark to commemorate a special date, plan ahead. One year is not long enough. And to be sure you have a registration in time for the special occasion, my advise is to plan two years out. You'll need the time. Afterall, Churchill Downs is a sophisticated trademark owner - they own more than 110 active trademark application and registrations. Some traditions are meant to be challenged. In 1970, a round of golf took 3 hours and 10 minutes. Today? We're looking at 5+ hours on the course. That's not progress - that's a problem. My solution? A shot clock: - 40 seconds for regular shots - 60 seconds for putts Will this ruffle some feathers in the golf community? Absolutely. Each golf ball has the logo of the business, and the balls are mounted non-destructively using a special technique for jobs just like this. You know what? I get it. I understand the trepidation, the fear, the reluctance. I also get that we are on the ground floor of an absolute revolution in the golf space right now with FlingGolf by New Swarm.
