QUESTION: Are soccer coaches independent contractors or employees? ANSWER: It depends. Soccer clubs across the country must have a solid understanding of the multiple tests for independent contractors. There is not just one test for independent contractor. Each body of law has its own analysis. The four major tests worth reviewing are: (1) workers compensation, (2) Fair Labor Standards Act, (3) Title VII, (4) the Internal Revenue Service Test. Each of the above referenced laws applies to employees- not independent contractors. Workers compensation encompasses employee injuries on the job. The FLSA involves overtime and minimum wage protections for employees. Title VII prohibits employers from discriminating against employees in the workplace. The IRS requires employers make certain deductions from an employee's paycheck. Notice, all of these laws hinge on the whether the individual performing the work is an employee. A club risks legal exposure when it classifies a coach as an Independent Contractor when in reality, the coach is an employee. Ironically now that I am the world of employee benefits, it's a topic I have been asked about by several friends and business owners in the industry.
