On June 23, McGuireWoods LLP summer associates from 14 offices met in Washington, D.C., for an incredible three-day retreat. They kicked things off with a private lecture on U.S. Supreme Court history, followed by deposition and negotiation workshops led by firm lawyers and a presentation on the business side of the firm. Isolating just the female representation in Partner promotions is a flawed approach when trying to understand if a law firm is on track to reach their DE&I goals. Yes, 38% isn’t top of the class, but without also taking into consideration how Latham perform in retaining their female Partners as well as the ratio of female Partners laterally hired into the firm, it’s very difficult to understand if Latham are in fact on track or not. For example, the most effective area for Latham to focus on in improving their female representation in the Partnership might NOT be in equalising Partner promotions. Instead, RETAINING or HIRING more female Partners than their current rate might be the most impactful areas to focus on in reaching a more gender diverse Partnership quicker. And how can firms know which area is going to be the most impactful one to focus on for their firm? Not only that, what each practice group within the firm should focus on? Data!!!! P.S. I was going to write a post about speaking at Kevin Wheeler’s “The Price is Right” forum on Monday for leaders in professional services M&BD alongside John O'Donoghue and Dexter Williams, but then Dexter said everything I was going to say - see his post below 👇 so I had to think of something different 🙄 Here are some pricing tips for M&BD colleagues to bear in mind when pitching for work: 1. You can make a difference - even if you’re not responsible for pricing, you can and should question and challenge those that are. Sensible questions include: Are we clear on the work involved? Do we need to discount by that much? Can we do the work for that price? 2. Speak to your clients! Really understand what they need, what it means to them and what their objectives are. They’ll likely want BAU work to be cheap, but mostly they will be seeking value for money and certainty over outright cost. 3. Be clear and transparent about your approach to pricing. Explain how you arrived at the price, use data to justify rates and rate increases and offer a choice of alternative fee arrangements. Great to be able to speak and be part of the panel at the Wheeler Associates’ ‘Price is Right’ forum, which was very kindly hosted by Kingsley Napley, and to be able to connect with peers from other professional services firms. The panel comprised Kevin Wheeler (Principal, Wheeler Associates), Verity Jackson-Grant (Head of Pricing, Simmons & Simmons), John O’Donoghue (Head of Legal Operations, Herbert Smith Freehills) and myself, as we tackled the issue of pricing within the professional services sector and explored the opportunities to both extract and deliver greater value. Conversation was lively with general agreement that there is the opportunity to achieve so much more in this area. I am sure this won’t be the last of these types of discussions.

You know the scientist dork in the action movie, the one the government ignores? This employment lawyer helps proactive companies avoid the action sequence.
We receive LinkedIn announcements from those in our network who land new jobs. Congratulations! Their excitement is contagious. But, is it wrong if I feel a little regret too? Here's the thing. My network includes #employmentlaw, #employeebenefits, and #ERISA attorneys. Where I work, employers of all sizes, localities, and industries thrive with support from fantastic colleagues. And "fantastic" might be selling them short. Eight are ranked in "2024 Best Lawyers in America." Nearly eighty more across other practice groups are on the list too. So, don't get it twisted. I rejoice. The rising tide they create floats many boats, including mine. But here's my regret. Would lawyers in my network have considered working with us instead of accepting the other opportunity I read about in the LinkedIn announcement? Part of what makes my job so special is this wealth of "Best Lawyers," who happen to be great people too. By nature, lawyers are risk-averse. So how will I know when others muster up the courage to look beyond their current employment to see if the grass is greener elsewhere? Perhaps I'll have to wait a few years until my clairvoyance gene naturally kicks in, as my doctor has advised that it's unsafe to continue experimenting with superhero origin stories from movies and comic books. In the meantime, I hope practicing lawyers (employment or otherwise) message me confidentially about the partner-only #lawfirm where attorneys collaborate remotely, have no billable-hour requirements, and keep up to 80% of the revenue they generate, split between the attorneys who find the work and those who grind on those matters. Don't expect anytime soon to see one of those LinkedIn new job announcements from me or any of my "besties," Sid Steinberg, Denise Delcore, Amy Epstein Gluck, Scott Agthe, Gordon Berger, Dan Messeloff, Mark Mathis, and Susan Warner.

Based on Leopard Solutions promotional data, there is a difference! Based on data from the last 4 quarters, looks like most International attorneys got promoted in Q1 and Q2. While the majority of US attorney promotions occurred in Q1 only.
