I'm pleased to share my latest piece for Law360: "NY Shouldn't Pair 421-a Restoration and Good Cause Eviction" Highlights: "GCE, as currently proposed, is a strict rent control system that would severely limit rent increases and, more generally, hamstring owners' ability to do what they wish with their properties. It doesn't take much of a logical leap to conclude that any incentive to create housing by a revived 421-a would, in part or in whole, be negated by GCE's disincentive effects. Given the critical need for new housing in New York and particularly New York City, the Legislature would be wise to decouple 421-a from GCE and focus exclusively on incentivizing the creation of more housing for their constituents." *** "Such a supposed grand bargain would be totally counterproductive and could actually make New York's housing shortage worse, as potential New York housing developers instead invest in the many states and cities throughout the U.S. without good cause or other rent control restrictions. In San Francisco, we turn to attorneys like Dan Bornstein to help owners and agents navigate the multitude of rent control and tenant provisions encountered in both leasing and selling properties with units. Here is a brief test for those not familiar. The answers to all questions are “Yes”. 1) Can an owner be fined for leaving a unit vacant for too long? 2) Does an owner need to tell the City each year who resides in each unit and what they pay? 3) If an owner wants to move into an occupied unit is there a fee to be paid to the tenant? 4) If you want to sell your 3+ unit building, do you 1st have to offer the building to a group of non-profits approved by the City? 5) Once under contract, do you have to again re-offer the property to the non-profits for their possible purchase at the accepted purchase price? 6) If a non-profit decides to purchase, is the first Buyer bumped out of contract? 7) Once a property is sold to a non-profit, does it remain a non-profit property forever? 8) If a buyout is agreed to between the owner and a tenant, does the City retain a copy of the agreement? 9) Average buyout for a tenant is about $50K. 10) Was the highest buyout paid to a tenant $470K? #SanFrancisco #apartments #cre #rents #buildings #rentcontrol #realtor #buyout #commercial #realestate #multifamily

This was a great team effort between Jesse Kanson-Benanav, Molly Rose Goodman, Jonathan Berk, John Infranca, and Justin Saif, in support of the Massachusetts Attorney General's Office and the Executive Office of Housing and Livable Communities's position in the MBTA Communities case now at the SJC. Here are the cliff notes: 1. Surprise, surprise, but Massachusetts has a severe housing affordability and supply crisis. 2. Restrictive and exclusionary zoning by municipalities plays a significant role in increasing housing costs and restricting supply. 3. Encouraging multi-family housing is good public policy, in part, because it prevents outmigration and improves housing affordability, which come with all sorts of local economic benefits. 4. The MBTA Communities Act, relatively speaking, is a modest zoning reform that will have significant and positive impacts.
