Know Your Rights as a Taxpayer: The Right to Finality Did you know that all taxpayers have the right to finality in federal tax matters? This is one of the 10 fundamental rights included in the Taxpayer Bill of Rights. You have the right to know the maximum time you have to challenge the IRS's position and the deadline for the IRS to audit a tax year or collect a tax debt. The IRS generally has 3 years from the date you file your return to assess additional taxes. However, this period can be extended in cases of unfiled or fraudulent returns. The IRS typically has 10 years from the tax assessment date to collect unpaid taxes, but this timeframe may be extended in certain situations, such as during bankruptcy or court proceedings. A Notice of Deficiency is the IRS’s formal proposal of additional taxes owed, and it must include a deadline to file a petition with the tax court. The IRS usually conducts only one audit per tax year, but they can reopen it if they suspect fraud or other serious issues. Understanding your rights can empower you when navigating tax challenges.
