I've chaired close to 3000 hearings in my career - Something I learnt from chairing so many over the years and, refining and improving how I chair them: Meeting the fairness requirements as detailed in the Labour Relations Act (including Schedule 8: Code of Good Practice on Dismissals) is the bare minimum a chairperson should be doing when chairing a hearing. My approach is to also ensure that people FEEL like they've been treated fairly in the hearing. Why? Because I care about how I treat people. But also... It saves resources for all. This was one of the thought provoking questions explored by the HR teams at the workplace fair employment legislation seminar we supported this week. What a great learning opportunity for everyone who attended, including team Catalyse! Kudos to the body of research which formed the basis of discussions. No easy task when operating across multiple juristictions. I thought I’d share a nugget of wisdom shared by their HR Director on how to approach grievances or complaints in a global organisation. She expressed it like a poem - the English version being Is it lawful - this being the minimum requirement. Can it be reasonable?
