A little known open secret is The National Labor Relations Board (NLRB) wields a significant amount of influence over your workplace, even if you may not realize it. Both political parties often appoint highly polarizing individuals to this board. This issue is particularly intriguing because it raises the question of whether requiring employees to be respectful is permissible. Yes, you read that right! The debate becomes in defining respectful, it might be disrespectful to call you boss a jerk while trying to unionize a workforce - is that free speech? Note: Free speech is severely limited in the workplace. If there's a difficult person in your workforce, it's best to find a way to help them transition to another job ASAP.

I've chaired close to 3000 hearings in my career - Something I learnt from chairing so many over the years and, refining and improving how I chair them: Meeting the fairness requirements as detailed in the Labour Relations Act (including Schedule 8: Code of Good Practice on Dismissals) is the bare minimum a chairperson should be doing when chairing a hearing. My approach is to also ensure that people FEEL like they've been treated fairly in the hearing. Why? Because I care about how I treat people. But also... It saves resources for all. How can global companies promote incusion for all staff, whilst respecting local legislation, customs and values? This was one of the thought provoking questions explored by the HR teams at the workplace fair employment legislation seminar we supported this week. What a great learning opportunity for everyone who attended, including team Catalyse! Kudos to the body of research which formed the basis of discussions. No easy task when operating across multiple juristictions. I thought I’d share a nugget of wisdom shared by their HR Director on how to approach grievances or complaints in a global organisation. She expressed it like a poem - the English version being Is it lawful - this being the minimum requirement. Can it be reasonable?
