In terms of the #ConsumerProtectionAct, anyone who receives, compiles, retains or reports any #confidentialinformation pertaining to a #consumer must protect the #confidentiality of that information. Running a small business?🤔💼 Ever come across an unfair or strange term in your contract? This could be in a contract with a manufacturer, a supplier, or even a client. Australian Consumer Law (ACL) protects you from unfair terms hidden in contracts, in an effort to support business owners and those doing the right thing. It does this by targeting something called 'unfair contract terms' (UCTs). So, what's an "Unfair" Term? 🟥 Something that introduces a significant imbalance in the contractual rights and obligations between both parties 🟥 The terms is not essential for protecting the legitimate interests of everyone involved - it's unnecessary 🟥 It could inflict financial or other harm on the parties if it's enforced So, what happens if you or your legal practioner determine a clause is unfair? 🙋♀️ That term becomes null and void - it is non-binding. However, the rest of the contract remains effective, if it can legally work without that unfair term. #businesslaw #businessowners #smallbusiness
