Environmental Risk or Environmental Opportunity? Yesterday's Marsh webinar hosted by Kimberly Mann and featuring Matthew Kern and Peter Kolodner highlighted another critical chapter in the risk management maturity playbook for the #energytransition. With over 450,000 brownfield sites in the US, numerous coal fired generating stations slated for closure and material credit enhancements available for those willing to develop / repurpose them, project sponsors are increasingly seeing the opportunity inherent in these locations - particularly in light of challenges associated with permitting, leasing, and interconnection. How significant is this? It's significant enough that one client actually scheduled a Phase 2 Environmental Site Assessment and told me "I hope we find something..." while a CEO of a major IPP told me that the sale of his thermal fleet "couldn't have happened" without a viable environmental risk management strategy backed by financial assurance. Greenfield environmental liabilities were also discussed, including lessons learned from catastrophic weather impacts, including storm-water runoff and sedimentation. With interveners citing potential impacts to sensitive environments, wetlands, waterways, etc. as a basis for reexamining whether distributed generation is benefit or a curse for their communities, effective environmental risk management becomes an accelerant on the permitting pathway. Thanks Mike! One question we didn't get to asked about key differences between AEGIS and Pollution Legal Liability (PLL) coverage. Generally speaking: (1) PLL includes 1st party/on-site cleanup costs; (2) PLL includes Non-owned disposal site coverage/liability for insureds waste disposal; (3) PLL can include coverage for pre-existing conditions (no retro date); and, (4) PFAS coverage is subject to underwriting.
