What an important step in recognizing the more subtle, but equally devastating forms of family violence. 75% of the Family Law self-reps I assist are or have struggled with a pattern of non-physical post-separation abuse. Education and awareness regarding the various forms of family violence is critical to developing solutions to reduce this behaviour in our family law courts.

The Protection of Women from Domestic Violence Act 2005 The Protection of Women from Domestic Violence Act (PWDVA) 2005 is an important piece of legislation enacted in India to provide legal protection and support to women who are victims of domestic violence. Here's an overview of the key provisions of the Act: 1. Definition of Domestic Violence: The PWDVA defines domestic violence broadly to include physical, sexual, verbal, emotional, and economic abuse or harassment by a person against a woman in a domestic relationship. It also covers acts of intimidation, coercion, and control. 2. Scope of Application: The Act applies to women in domestic relationships, including wives, live-in partners, mothers, sisters, and female relatives who are subjected to domestic violence by a male family member. 3. These orders may include provisions for temporary custody of children, possession of shared residence, and financial support. 3. Queensland has passed the law which includes coercive control as a stand alone offence. Not all States and Territories will follow assuming that this behaviour is covered by existing law. As a family violence advocate and someone whose work very much deals with coercive control - it is disappointing not to see this universally adopted. Coercive control is at the centre of all forms of family violence. It can also be the most difficult for the ill informed or uneducated to detect and deal with. It is too frequently lethal. Lawyers - as much as first responders- need to be trained in detecting all forms of family violence but also need to be trained in what to do and how to best advise clients. Whilst extremely relevant for family lawyers - all lawyers should be trained in family violence dynamics - from the property lawyer asked to advice on mortgage documents to the corporate and tax lawyer working with family companies. We need to get better at this and the key is training and education.
