Transparency and no greenwashing is what we need on sustainability claims including NetZero goals and in business in general. This company’s actions (corrupt, misleading and greenwashing) also confirms me the right choice of not consuming meat at all. We need to change our way of life and change food habits it’s one of them. If we all start doing it even if it is in a gradual scale like eating half of what you eat on meat especially beef, your contribution will be accounted by our planet and also by the investors, which should move out of industries that are bad for our only planet and place where we can live.

In another huge blow to JBS, New York State Attorney General Letitia James today announced she is suing the company for fraudulent climate claims. "JBS USA’s greenwashing exploits the pocketbooks of everyday Americans and the promise of a healthy planet for future generations. My office will always ensure that companies do not abuse the environment and the trust of hardworking consumers for profit," James said. The lawsuit centers on JBS' claims that it was on on track to achieve net-zero emissions reductions by 2040, even though the company had not fully assessed its footprint - and at the same time that it was planning to dramatically increase its livestock slaughter, and hence its carbon footprint. The Better Business Bureau's National Advertising Division had found that the evidence didn't support these claims, and recommended that JBS stop making them. Nonetheless, JBS CEO restated these claims onstage in an interview with The New York Times' David Gelles just this past September, and continues to make them on its webpage. The lawsuit seeks to force JBS to stop making misleading climate claims, disgorgement of profits from false marketing, and penalties of at least $5000 per violation. James' lawsuit is another sign, following JBS' announcement last week that it is delaying its IPO after a bipartisan group of senators called on the SEC to stop it, that the company's outsized climate and deforestation footprint is getting in the way of its business plans. As we have recommended to JBS' CEO and other executives, they need to stop claiming they're doing something about the climate, and start actually doing it. Her focus on JBS and the meat industry coming on the heels of her huge victory in court against Donald Trump makes her not just a climate hawk, but a real American legal hero. Her case is also sending a broader signal that there are serious financial penalties for greenwashing. But even if we could magically reduce fossil fuel emissions to zero tomorrow, according to data scientist and Oxford researcher Hannah Ritchie, our current food systems mean we’d still blow “well past the 1.5 degrees carbon budget, and use up nearly all of our two degrees budget”. A group of UK politicians has written to the chair of the U.S. Securities and Exchange Commission (SEC) calling for it to reject Brazilian meat giant JBS' proposal to list on the NYSE over "grave concerns" about the company's climate impact. In a move that further demonstrates the growing global concern about the JBS Initial Public Offering (IPO), the twelve UK parliamentarians, led by Lord Zac Goldsmith, detail JBS' "well-documented history of engaging in deforestation, violating human rights, and seizing land from Indigenous communities." In January of last year, Mighty Earth lodged a whistleblower complaint with the SEC, calling for a full investigation into alleged misleading and fraudulent “green bonds” issued by JBS. The complaint centred on the fact that JBS based the bond offerings on its commitment to achieve net zero emissions by 2040 – but that its emissions have increased in recent years and excluded ‘Scope 3’ supply chain emissions that comprise upwards of 90% of its climate footprint. In August of last year, we wrote again to the SEC contesting the validity of the information in JBS' IPO prospectus, highlighting that it underestimates the company’s climate impact and misleads both the SEC and potential investors. Like the UK lawmakers, we oppose the NYSE listing as it would give JBS access to billions of dollars in capital to fund its ambitious plans to expand its industrial meat operations in the United States, Brazil and beyond. The company’s long history of lawlessness demonstrates what could happen if JBS has access to the American capital markets: more deforestation, more grabbing of Indigenous lands and more outsized climate impact. This goes against global efforts, announced recently at #COP28, to address the food industry's impact on climate and nature. A real test this for New York's, and the United States' climate credentials because it can either face this prospective issue head on, or opt for the financial rewards that will come with allowing JBS to list. No wonder the market for 'Sustainability-Linked bonds' (SLBs) is tanking. US, UK Lawmakers Urge SEC to Scrutinize JBS Listing. Critics express concern over the global meatpacker's ties to deforestation and its history of misleading investors. Lawmakers in the US and UK are urging the Securities and Exchange Commission to examine JBS' plans to list on the New York Stock Exchange. A bipartisan group of 15 US senators pressed the agency to scrutinize JBS' draft filing for any incomplete or inaccurate disclosures, while British lawmakers called on the SEC to send a clear message against climate change. JBS, the world's largest meatpacking company, has faced criticism for its decision to list in the US due to environmental concerns surrounding its operations in the Amazon rainforest. Environmental groups and lawmakers argue that the listing would give JBS access to more capital and credibility, despite its alleged role in deforestation. Super appreciative of the Office of the New York State Attorney General for taking on the world's largest beef producer JBS USA for greenwashing and misleading consumers. JBS is notorious for driver deforestation of the Amazon, getting embroiled fraud and bribery and corruption schemes, mistreating workers, and trampling on Indigenous rights. As Todd Paglia at Stand.earth says: "We need to stop the rise of greenwashing and increase accountability for corporations like JBS who mislead consumers with false climate and sustainability claims. This lawsuit should put others on notice as well, including the banks that continue to fund JBS and other extractive industries like oil and gas in the Amazon.
