The European Commission issued an update on the EU Deforestation Regulation (EUDR), in which it announced it was proposing a 12-month delay to the implementation of the law. This move is potentially disastrous for the world’s forests, and Mighty Earth strongly condemns the Commission for bowing to pressure from some governments and regressive industry bodies, when millions of euros and tens of thousands of hours had been spent by people, companies, governments, farmers and others who were readying themselves for EUDR compliance. At a time of growing Nature and climate crisis, including fires engulfing much of the Amazon, this decision shows an absence of political leadership. JBS’ plans to list on the NYSE faces further scrutiny from investors and NGOs. Eighteen investors, representing US $22.2 billion in assets under management, have co-signed a letter to US Securities and Exchange Commission U.S. Securities and Exchange Commission EC Chair Gary Gensler, raising serious concerns over JBS environmental reporting. In parallel 20 leading NGOs have released a new briefing for investors, outlining key risks in JBS’ renewed SEC application. Analysis of JBS Initial Public Offering (IPO) application reveals the company removed references to ‘zero tolerance’ to the invasion of protected areas, including Indigenous lands and environmental conservation zones. This omission has sparked serious concern, given that as recently as September of this year, Mighty Earth found, JBS was reportedly linked to the invasion of Indigenous lands in Brazil and deforestation of over 18,000 hectares of land in the Amazon and Cerrado ecosystems.    Further concerns for investor and the SEC, outlined in the briefing, highlight JBS’ liabilities from criminal, civil and other legal proceedings increased substantially from $1.7 billion in July 2023 to $3.6 billion in June 2024. This figure failed to include estimated penalties related to the State of New York case brought against JBS USA for an allegedly ‘unsubstantiated and misleading’ Net Zero 2040 target. JBS S.A. was delisted by the Science-Based Targets initiative (SBTi) for failing to submit a climate plan, despite its continued Net Zero 2040 claims. Traceability and transparency are the first step towards sustainable supply chains.    On the most recent episode of BBC Radio 4’s The Food Programme with Leyla Kazim, Thea Parson, Senior Climate & Forests Associate at Mighty Earth, uncovers the mystery behind the cashew nut industry.    If you look at a packet of cashew nuts in the supermarket, the label will often say “mixed origin”, leaving consumers with little information on where their nutritious snack came from. We know that supply chain traceability is the first step towards sustainability.
