For those interested in mining disputes, Jaime Gallego and I have published an article in the tribute book to Miguel Angel Fernández-Ballesteros (in Spanish, at pages 819-838) analysing a topic that investors whose mining activities/projects are affected by actions of rural or native communities (led by their authorities) may want to look into carefully: can the actions of those communities be attributed to the State under international law to conclude that the State violated its international obligations vis-à-vis investors? We examine the case of Peru, a country with a detailed legal framework where the authorities of rural and native communities enjoy powers and prerogatives that can only be described as extensive.
