Interesting discussion about jury selection and the planting of undercover police in that process. The officer was assigned out of jusirdiction to investigate extremeism towards the Aurora Colorado police department. It appears no intelligence was gatherd. Instead the officer listened to prospective jurorcomments that led to a juror being dismissed after the juror refuted making the alleged comments. Should this process be allowed? #police #racialprofiling #jury #juryselection #legal #law #litigation #courts
Should this be allowed? "Court transcripts reveal that Aurora Police had assigned an undercover officer to the courthouse and she disclosed information that ultimately lead to a prospective juror of color dismissal in the first trial of the police officers charged in Elijah McClain's death". This officer was out of jurisdiction and "...sent to the courthouse, city officials say, to see if anyone was potentially planning to attack the APD (aurora police department) headquarters". "That officer never reported gathering any information about protests during jury selection, APD’s decision to place an undercover officer in the courthouse that day who listened to jurors eventually led to the exclusion of a juror of color, prospective juror 14, from the panel". #police #racialprofiling #jury #juryselection #legal #law #litigation #courts

To be considered just, criminal proceedings must not only be fair but also timely. Nazar Kulchytskyy shared his thoughts on how to expedite the path to justice at #JustConf2023. Indeed, participants in criminal proceedings often resort to delaying court proceedings. The challenge lies not only in the voluminous scope of criminal proceedings but rather in the fact that even human life span is sometimes insufficient to see them through. As a result of such delays, trust in the criminal justice system diminishes, raising a pertinent question of whether the system truly strives to be efficient. A change in approaches would provide the opportunity to circumvent such situations. Enjoy this extremely thought-provoking piece from the Bettering Justice Blog. It explores the Magistracy’s potential to ameliorate criminal activity by addressing the factors that may form the very the genesis of same #therapeuticjurispridence Excerpt: “…for a holistic, rather than punitive, sanctioning model of adjudication, magistrates should be open to a problem-solving approach which would include the offenders, the victims and members of the related community in an interactive process; a process which would only be effective if Magistrates are willing to create a supportive environment, where some form of ‘emotional or social connectedness’ between the parties can occur”. What are your thoughts?

Chief Justice González is the real deal! Read this excellent article by Judge Mansfield (also an excellent, excellent judge and human being) before marking your ballots for the Supreme Court.
In 2021, I wrote a wide-ranging interview with Washington State Supreme Court Justice Steven González that was published in the Washington State Bar Association’s Bar News magazine. His ideas about the future of justice in this state and in America still ring true. https://lnkd.in/gADVDyWg
